Do I Have a Right to Choose My Medical Provider?
If you are receiving workers' compensation benefits in Missouri, your employer (or the insurance company handling the claim) has the right to choose your medical provider. While many injured workers do not like this, unfortunately it is the law in Missouri.
Typically, your employer or their insurance carrier will send you to a workers' compensation clinic such as Concentra, Corporate Care, or OHS-Compcare, which is a facility with a group of doctors who treat only injured workers. The physicians at the workers' compensation clinic will often refer you to a specialist outside of the clinic if your injury requires specialty care.
Can I Receive a Second Opinion if I Do Not Agree With My Doctor?
You are required to receive your care from the authorized workers' compensation doctor until that doctor releases you to return to work or places you at maximum medical improvement. Once you are released and you are unsatisfied with the treatment you received, you can exercise your right to obtain an independent medical examination. In Missouri, you will have to pay for this second opinion. However, the cost may be worthwhile if you believe you are still injured and would like additional medical treatment.
