If you are hurt on job and unable to work in Missouri due to your work injury, you will receive a wage benefit from workers' compensation. This benefit is referred to as temporary total disability (TTD) compensation. This is compensation paid to you by your employer's workers' compensation insurance carrier and is intended to compensate you while you are recovering from your work injury. This benefit is also available to the injured worker if the authorized treating doctor assigns work restrictions and your employer is unable to accommodate those restrictions. If your employer is unable to accommodate your work restrictions, you are entitled to temporary total disability (TTD) compensation.
At the law firm of Spooner & Perkins, P.C., we offer a free initial consultation to discuss your workers' compensation wage benefit if you have been injured on the job. Our attorneys represent injured workers throughout the Kansas City metro area and rural Missouri.
How Is Temporary Total Disability Calculated?
Temporary total disability or TTD is based on two-thirds of your average weekly wage, up to certain maximum limits determined each year by the Missouri Division of Workers' Compensation. Your average weekly wage is determined by adding your gross wages, before taxes and other deductions are taken out, for the 13 week period prior to your injury. You simply add your entire earnings for the relevant 13-week period before your injury and divide by 13. This will give you your average weekly wage (AWW). Once your average weekly wage (AWW) is calculated, we then look at what 2/3 or 66.67 percent of the AWW is to arrive at the amount of your TTD check. Here is an example:
$600 (average weekly wage) x .667 = $400.20 temporary total disability
It is important to note that workers' compensation temporary total disability benefits are tax free.
What if My Employer Miscalculates My Benefits?
It's not unusual for the workers' compensation insurance carrier to miscalculate your TTD benefits and pay injured workers too little. Our lawyers offer a free consultation to review your temporary total disability benefit calculation and determine if you are receiving all of the pay you deserve.
How Long Do I Receive Workers' Compensation Pay?
Your temporary total disability benefits typically continue until:
- Your doctor releases you to go back to work, or
- Your employer can accommodate your work restrictions with a light-duty work assignment.
If your employer offers you a light-duty work assignment, you are required to take it or your workers' compensation benefits could be suspended. The good news about returning to a light-duty assignment is that you will receive your full wages rather than 2/3 of your earnings.
